It is widely agreed among health professionals that couples using donor insemination should be offered counselling on the topic of donor conception disclosure. However, it is clear from the literature that there has long been a lack of agreement about which counselling approach should be used in this case: a directive or a non-directive approach. In this paper we investigate which approach is ethically justifiable by balancing the two underlying principles of autonomy and beneficence. To overrule one principle in favour (...) of another, six conditions should be fulfilled. We analyse the arguments in favour of the beneficence principle, and consequently, a directive approach. This analysis shows that two conditions are not met; the principle of autonomy should not be overridden. Therefore, at this moment, a directive counselling approach on donor conception disclosure cannot be ethically justified. (shrink)

This schedule, provided as a companion to my “Teaching Firefly” article, was used for a sophomore level philosophy course that was populated mostly by non-majors. The original idea for the course was to develop a popular culture philosophy course that would attract students from all over campus, which was meant to both introduce them to multiple philosophical ideas and theories and hopefully convince some of them to major or minor in philosophy. The course was quite successful at drawing Whedon fans (...) from across the university (after a certain amount of advertising through posters and social media). Forced displacement and silencing are inextricably bound for communities who have experienced different forms of violence in different contexts. This article explores the narratives about the war that began on 5 October 2017 in the district of Mocímboa da Praia, on the coast of the province of Cabo Delgado, northern Mozambique, by a group of radical guerrillas locally known as mashababe. Since then, from isolated attacks on remote villages, violence has spread to more districts in the region, with kidnappings of (...) civilians, looting of barns and houses, thus imposing the forced displacement of hundreds of thousands of people in addition to an inestimable number of dead and missing people. This article combines the history and ethnographic work carried out between 2018 and 2021 with the homeless populations from conflict regions and hosted in the 'Nacaca Displaced Persons Camp' (Campo de Deslocados de Nacaca), built in the district of Montepuez, south of Cabo Delgado, a region previously considered safe. The aim of this paper is to analyse how the multiple faces of traumatic violence (physical, psychological and symbolic) are processed in which war victims are continually exposed through silencing imposed by different actors who frequent their new places of refuge. BIOGRAFIAS NÃO AUTORIZADAS: UMA DISCUSSÃO INÓCUA NO BRASIL?

Although regulators have identified ethical lapses as a key factor contributing to auditors’ failure to detect their clients’ fraudulent financial reporting, research using ethical theory to examine auditors’ fraud detection remains limited. We provide evidence on the joint effect of ethical idealism and trait skepticism on auditors’ fraud judgments. Ethical idealism reflects an individual’s concern for the welfare of others while trait skepticism reflects an individual’s disposition to validating a proposition. Forsyth theorizes that there is an association between ethical idealism (...) and tolerance for deception. Drawing on that insight, we posit that ethical idealism and trait skepticism have a complementary effect on auditors’ fraud planning performance. This is because the former determines an auditor’s tolerance for allowing a client to get away with an ethically questionable act while the latter is important in determining how evidence is generally sought and evaluated. We used the Forsyth ethical position questionnaire to measure ethical idealism and the Hurtt :149–171, 2010) scale to measure trait skepticism. Our results indicate that there is a significant positive association between trait skepticism and the number of effective audit procedures but only for auditors who have high ethical idealism. The results highlight the importance of measuring and controlling for the effects of these traits when evaluating fraud detection performance. The paper also contributes by showing that an ethics theory can generate additional understanding of and insights into an important accounting phenomenon. (shrink)

J. Šmajs’ concept of evolutionary ontology has attracted much attention in recent years especially in Czech and Slovak academic circles, yet it remains, as some of its proponents claim, undervalued in Britain and the US. Even in the Czech Republic and Slovakia, there are, in addition to its strong supporters, several authors who almost a priori reject the concept, pointing to several questionable, contradictory or even mutually exclusive or self-refuting arguments. In this paper, mainly based on a comprehensive analysis of (...) the first part of Šmajs’ book, Evoluční ontologie kultury a problém podnikání (2012) [Evolutionary Ontology of Culture and The Issues Of Business], we attempt to demonstrate that the opponents of Šmajs’ concept are closer to the truth, since the concept, we believe, is just another variation on the extreme escalation of philosophical naturalism. Already at a relatively early stage, modern sign language linguistics focused on the representation of (actions, locations, and motions of) referents (1) through the use of the body and its different articulators and (2) through the use of particular handshapes (in combination with an orientation, location, and/or movement). Early terminology for (1) includesrole playing, role shifting, androle takingand for (2)classifier constructions/predicatesandverbs of motion and location. More recently, however, new terms, includingenactmentandconstructed actionfor (1) anddepicting signsfor (2) have been introduced. This article (...) provides a brief overview of the history of enactment and depiction in the sign linguistic literature but mainly focuses on issues related to terminology (and terminology shifts). First, we consider the relation between role shifting and constructed action. We question the idea that these terms can be used interchangeably and rather suggest that they capture different, but related functions. Subsequently, we zoom in on the conceptualization of depicting signs, indicating verbs, pointing signs and fully lexical signs and the relation between these signs and the method of depicting. Where earlier research often associates depicting with the use of specific types of structures, we promote the idea that depicting is a semiotic diverse practice. In doing so, we show that the conceptualization of the different sign types and the terms that are used to refer to these phenomena do not accurately capture the way these signs are used in actual signed discourse and propose a reconceptualization of the different sign types in the lexico-grammar of Flemish Sign Language (VGT) as composite signs that can describe, depict and indicate meaning in various ways. In this way, this article illustrates (1) the risks that may come with the execution of terminology shifts and (2) the importance of making a clear distinction between form and function, i.e., we show that it is important to be careful with assuming a (too) exclusive relation between a certain function and one or more particular forms. The development of this paper is presented in two moments. In the first, the analysis of the literacy method of master Paulo Freire is made. However, he ceases to be approached as a simple set of reading and writing techniques to highlight the “anthropological, ethical and political proposal to rescue the ontological vocation of men and women, which, among others, materializes in the right to read world. In the second, the focus is on the relationships between Freire's pedagogical thinking and (...) the theory of Brazilian nationalism-developmentalism developed within the ISEB in the period between 1959 and 1964. The central argument is that Paulo Freire's position is opposed to that of the elites, to the closed society and identified with the nuances of conservative populism that massifies, fanatizes and prevents the simple men from being participants and agents of the transformation process that they consider fundamental; the education proposed was essentially transformative and liberating. Throughout the development of the text, the importance of Paulo Freire and the reasons for occupying this prominent place in the history of Brazilian and world education are always emphasized. Using an interpreter in qualitative interviews: does it threaten validity?There is an extensive literature on the problem of translating scales for use across cultures, but very little is published on the problems of conducting qualitative interviews in another language with assistance of an interpreter. The aim of this paper is to describe and discuss threats to validity that arise when conducting qualitative interviews using an interpreter. Ten female student nurses in two cities in Lithuania were interviewed about how they perceived (...) their educational program. All interviews were conducted in English with an interpreter. When using an interpreter to conduct interviews, potential threats to validity arise at various points in the interview process. A threat arises when the researcher, whose first language is Swedish, addresses a question in English to the interpreter, another during the translation by the interpreter from English to Lithuanian, and again when the interpreter translates the interviewee’s Lithuanian responses to English. In the last situation, the researcher may not know whether the interpreter has summarized and/or modified the responses. To mitigate these problems, the interpreter should not only have the required linguistic abilities, but also be trained in the research field. The researcher has to be aware of these threats to validity and make efforts to meet and limit their effects. (shrink)

ATIVIDADE CURRICULAR EM COMUNIDADE E SOCIEDADE E OS POVOS TRADICIONAIS: EXPERIÊNCIA DE CAMPO DO CURSO DE DIREITO DA UNIVERSIDADE FEDERAL DA BAHIA.

Cinema has long played a crucial role in the way that societies remember and represent themselves. In the last quarter century, film has been an important medium in the public debate around the memory of the Holocaust and of Hiroshima; of the Algerian war for independence and of the Spanish Civil War; of the Allende legacy in Chile, the utopian dreams of 1968, and the aborted project of the German Democratic Republic; in identity formation in Palestine and in the African (...) diaspora. Hedges discusses the role of cinema within a global perspective that spans five continents, and proposes an original typology of cultural memory. In the process, she re-evaluates the contributions of major directors and uncovers hitherto neglected yet important works. The author develops her arguments in an approachable style that will encourage readers to rethink their own memories of films and to reflect on the way that cinema contributes to collective and cultural memory. La siempre fascínate escritura rulfiana continúa dialogando con el mundo. El así conocido “escritor de las letras mexicanas”, nos sigue ofreciendo un mar de posibilidades de acercamiento a otras áreas humanísticas entre las cuáles incluimos a la filosofía. Coincidentes en la época y en la geografía mexicana, Juan Rulfo y María Zambrano se encontraron en 1939. Exponentes ejemplares y creadores de nuevos caminos en la escritura literaria y filosófica, los exponemos como paralelos a través de dos piezas claves de sus (...) obras: Pedro Páramo y Los sueños y el tiempo. La antropología zambraniana viene propuesta como uno de estos senderos creativos y creadores de la búsqueda del propio ser y del sentido mismo del existir. Dicho pronunciamiento antropológico lo exponemos como perspectiva de lectura del viaje no sólo de Juan preciado, ansioso buscador de su padre, sino de todos los lectores de Rulfo que hemos tejido con sus letras —extractoras de sueños y productoras de anhelos— la frágil cuerda que sostiene la aventura del descubrir nuestro lugar en el oscuro pozo del mundo. Realismo mágico y Razón poética en armonía propositiva que revela el origen de ambos proveniente de la misma semilla del ser. Philosophers unknowingly subscribe to two competing conceptions of philosophy. On the inclusive conception, teaching philosophy provides a valuable social good that should be distributed as much as possible. On the traditionalist conception, certain materials and techniques constitute the way philosophy should be taught, which must be conserved. Unfortunately, the traditionalist conception clings to methods that have repeatedly produced an elitist, hierarchal version of philosophy that inhibits diverse engagement. Given the value of philosophy, philosophers have a duty to distribute philosophy to (...) a greater number of people, which requires embracing the inclusive conception. Acting towards this duty can be done by working beyond the classroom, spreading philosophy through service, and improving our teaching both to reach a more diverse audience and to follow pedagogical research, such as with experiential learning techniques. Philosophers should also ensure that the duty’s burden falls more on privileged philosophers who can take on the necessary sacrifices. (shrink)

While virtually everyone recognizes the moral permissibility of whistleblowing under certain circumstances, most theorists offer relatively conservative accounts of when it is allowed, and are reluctant to offer a full recommendation of the practice as an important tool towards addressing ethical failures in the workplace. We think that accounts such as these tend to overestimate the importance of professional or personal obligations, and underestimate the moral obligation to shine light on severe professional malfeasance. Of course, a whistleblower, even an anonymous (...) one, often faces serious threats of retaliation and harm to their professional livelihoods and well-being. To address these challenges we argue in favor of a practice that we will call Preemptive Anonymous Whistleblowing (PAW). Such whistleblowing is preemptive in that a whistleblower provides information about malfeasance to a party in a position to do something about it without first raising the worry to one’s immediate superiors. At first blush, such preemption may seem unsettling, and PAW admittedly raises a number of worrisome issues. We defend PAW, however, as part of a larger argument that whistleblowing is morally required more often than is commonly thought. The availability of PAW as an option provides a method for allaying the concern that whistleblowing can be overly burdensome due to the risks of job and career. Insofar as that concern can be allayed, it is feasible for there to be substantial moral requirements to engage in whistleblowing in cases where severe harms can be prevented. With high enough stakes, there is a moral requirement for whistleblowing. (shrink)

The question whether compulsory schooling is justifiable or not has been treated at considerable length by critics, defenders, and positions in-between. What these treatments—about paternalism and autonomy and institutionalization and more—have not directly analyzed is a question that precedes the issue of overall justification: the preliminary question of time. Does it matter when compulsion takes place? Furthermore, does the timing of compulsion matter to the question of overall justification? Deep beneath the Jack the Ripper story, Alan Moore and Eddie Campbell use From Hell to argue for a philosophical thesis: Although physical violence and structural violence are quite different, they are also interconnected as each causes the other to worsen. William Gull claims that through the Ripper murders, he has “delivered” the twentieth century, as seen in his premonition of the mundane office place. In other words, Gull believes that the Ripper murders somehow played a foundational role in creating (...) twentieth-century life. This premonition suggests that horrific murders like those of the Ripper make structural violence, such as that found in the contemporary office place through wrongs such as sexual harassment, recede into the background of society where it becomes invisible and taken for granted. As Gull sees his violence as particularly connected to his misogynist worldview, From Hell makes the clearest case for the connection between physical violence and structural violence through the problem of patriarchy. I analyze the deimopolitical functioning of cisgender-straight-bolsonarist masculinity as a norm of recognition characterized not only by the fear of penetrating the anus, but essentially marked by the fear of having an anus. I seek to analyze the production of fear of the existence of the anus as an intrinsic element in the fabrication of supposed social threats in cisgender-straight-bolsonarism. Through a topographic metaphorization that locates/means the excluded as the anus of the social, the “enemy” appears as a mark of (...) the anal memory, reminding that the anus exists. If it exists, it can be penetrated. In this way, the existence of the anus organizes the differential distribution of humanity in this regime, as the minimum condition of being a human being is that of being a man, that is, not having an anus. This condition is reaffirmed by other markers of absence: not having a vagina, not having black skin, not belonging to ethnic and religious minorities... Cisgender-straight-bolsonarism behaves like an anatomical engineering in which the anus works as a catalyst for a masculinist reaction. The dermal tube is then reformatted in this regime. With this, I try to show that the fear of the existence of the anus is a central element of subjective enunciation and fascist recognition in this community. (shrink)

This work presents a post-positivist research framework for explaining any surprising or anomalous fact in the evolutionary path of a complex, dynamic, and contingent social process. Firstly, it elaborates on the reconciliation betweenthe ontological and epistemological assumptions of Critical Realism with the principles of American Pragmatism. Next, the research method is presented: theoretical propositions about a social structure are translated into a set of grammar rules that acknowledge patterns of sequences of events, either involving individual action or interaction between actors (...) within a real social system. The result is a discrete mathematical model for a concrete category of social process based on these rules. Finally, data-grounded refinement of the theory is possible through comparison between cases belonging to the same category, but differing in some contingent pattern of sequences of event outcomes. Consequently, their grammars differ in some pairs of context-sensitive rules that explain this surprising fact, and the derivation of this alternative historical trajectory of event outcomes becomes an extension to the early category of social process. In this sense, the proposed framework suggests a hierarchy of classes of grammars for middle-range explanations based on the ontological assumption of the generative nature of social reality. Apresento e desenvolvo neste artigo o problema da prova sortuda, analisando duas soluções para ele presentes na literatura. A primeira delas consistira em alegar que mostrar que o predicado está contido no sujeito não basta como demonstração da verdade de uma proposição, sendo preciso que se prove ainda que a noção relativa ao sujeito é logicamente consistente. A segunda repousaria em uma hierarquização modal, por assim dizer, dos pre- dicados integrantes de uma noção individual. Após exibir as razões que me (...) levam a rejeitar essas duas soluções, apresento os traços fundamentais de uma interpretação que me parece resolver o problema de maneira satisfatória. Minha posição envolve conceder ao Princípio da Razão Suficiente um papel central na compreensão do que significa, para Leibniz, provar que um determinado predicado está contido na noção relativa a um certo indivíduo. O presente artigo traz reflexões que envolvem infância e experiência a partir da área da educação e, particularmente, das ponderações em torno das pesquisas com crianças pequenas e da educação infantil. Os apontamentos impõem limites relativos a este lugar de estudo e delimita estes como parte de uma crítica e autocrítica da educação e das possibilidades de consolidação de uma Pedagogia da Infância. Nesta direção, no artigo se toma para esta reflexão a análise do sentido da experiência para as principais (...) teorias educacionais ou projetos educativos para a educação na infância, a fim de levar a uma demarcação dos contornos da experiência educativa na/da infância institucionalizada. Para tal, apresenta alguns elementos relativos à experiência educativa como experiência social a partir de estudos empíricos que dão visibilidade às ações das crianças como parte de suas vidas nos coletivos infantis. Por fim, indica como desafios para a possível consolidação de uma Pedagogia da Infância uma aproximação da Pedagogia às manifestações infantis, a criança em situação e as possibilidades de os processos educativos se pautarem na escuta, na dialogicidade e nas relações, possibilitando incluir, nas práticas educativas, as significações produzidas pelas próprias crianças em seus contextos de vida e suas manifestações culturais e expressivas. Reflexões sobre Professoralidade, Profissionalização, Profissionalidade, Profissionalismo e sua relação com o Desenvolvimento Profissional Docente Resumo: Várias são as categorias teóricas que guardam relação com o tema desenvolvimento profissional docente. Professoralidade, profissionalização, profissionalismo são algumas delas, mas geralmente não aparecem conjuntamente nem em relação do DPD. Por isto, este trabalho visa a analisar estes conceitos em relação ao DPD. A investigação foi desenvolvida a partir de metodologia baseada na pesquisa bibliográfica. Os argumentos evidenciaram que o DPD, na atualidade, perpassa questões da (...) professoralidade, da profissionalização, da profissionalidade e do profissionalismo, mesmo que em intensidades diferentes. Profissionalidade e professoralidade são aqueles que mais dizem respeito a uma estreita vinculação com o desenvolvimento profissional docente por se relacionarem de forma imbricada sem que se possa separar um do outro, ao passo que no profissionalismo e na profissionalização não existe uma relação de complementariedade ou espontânea, mas sem dúvida ambos os lados da relação podem se beneficiar um do outro.Palavras-chave: Desenvolvimento Profissional Docente, Professoralidade, Profissionalização, Profissionalidade, Profissionalismo. Reflections on professorality, professionalization, professionality, professionalism and its relationship with the teacher professional development: There are several theoretical categories that are related to the theme of teacher professional development. Professionality, professionalism, professorship, professionalization are some of them, but generally do not appear together in relation to the TPD. For this reason, this work aims to analyze these concepts in relation to the TPD. The investigation was developed based on a bibliographic research methodology. The arguments showed that the TPD, at present, runs through issues of teaching, professionalism, professionalism and professionalization, even if at different intensities. Professorship and professionality are those that most relate to a close link with the professional development of teachers because they relate in an interconnected way without being able to separate from each other, whereas in professionalism and professionalization there is no complementary or spontaneous relationship, but no doubt both sides of the relationship can benefit from each other.Keywords: Teacher Professional Development, Professorship, Professionalization, Professionality, Professionalism. Resumen: Existen varias categorías teóricas relacionadas con el tema del desarrollo profesional docente. Profesoralidad, profesionalización, profesionalidad, profesionalismo son algunos de ellos, pero generalmente no aparecen juntos o en relación con el DPD. Por esta razón, este trabajo tiene como objetivo analizar estos conceptos en relación con el DPD. La investigación se desarrolló en base a una metodología basada en la investigación bibliográfica. Los argumentos mostraron que el DPD, en la actualidad, atraviesa problemas de enseñanza, profesionalización, profesionalismo y profesionalismo, incluso a diferentes intensidades. La profesionalidad y la enseñanza son las que más se relacionan con un vínculo cercano con el desarrollo profesional de los docentes porque se relacionan de manera interconectada sin poder separarse entre sí, mientras que en el profesionalismo y la profesionalización no existe una relación complementaria o espontánea. Given the plethora of weight loss interventions, Devine and Barnhill rightly propose to also investigate unintended consequences. I agree. Some questions need to be raised: unintended consequences is a messy concept. How to distinguish between surprises and pseudo-unintended consequences? How to make sure that such research is not a box-ticking formality? And will results be implemented?

The relationships among character strengths (forgiveness and gratitude), happiness, and pro-social bystander behavior in bullying were analyzed. The sample includes 500 (early adolescents) and 500 (middle adolescents) of both genders, between 12 and 18 years old (M age = 14.70, SD = 1.58). Two structural equation models were calculated. Results of the first model indicated that forgiveness, gratitude, and happiness had a direct positive relation with pro-social bystander behavior. Furthermore, human strengths were indirectly related to prosocial behavior in bullying for (...) this effect in happiness. The second model showed that pro-social bystander behavior had a positive effect on human strengths and happiness. Multi-group analyses indicated that gender and stage of adolescence did not moderate the relations found in the model. Overall findings suggest a reciprocal relationship between character strengths, happiness, and pro-social bystander behavior. (shrink)

This article provides an overview of recent contributions to the debate on the ethical use of previously collected biobank samples, as well as a country report about how this issue has been regulated in Spain by means of the new Biomedical Research Act, enacted in the summer of 2007. By contrasting the Spanish legal situation with the wider discourse of international bioethics, we identify and discuss a general trend moving from the traditional requirements of informed consent towards new models more (...) favourable to research in a post‐genomic context. Informed consent is a key condition for prenatal screening programmes to reach their aim of promoting reproductive autonomy. Reaching this aim is currently being challenged with the introduction of non‐invasive prenatal testing (NIPT) in first‐trimester prenatal screening programmes: amongst others its procedural ease—it only requires a blood draw and reaches high levels of reliability—might hinder women’s understanding that they should make a personal, informed decision about screening. We offer arguments for a renewed recognition and use of informed consent compared to (...) informed choice, and for a focus on value‐consistent choices and personalized informational preferences. We argue for a three‐step counselling model in which three decision moments are distinguished and differently addressed: (1) professionals explore women’s values concerning whether and why they wish to know whether their baby has a genetic disorder; (2) women receive layered medical‐technical information and are asked to make a decision about screening; (3) during post‐test counselling, women are supported in decision‐making about the continuation or termination of their pregnancy. This model might also be applicable in other fields of genetic (pre‐test) counselling, where techniques for expanding genome analysis and burdensome test‐outcomes challenge counselling of patients. O presente artigo tem como objetivo analisar as implicações críticas da imunização biopolítica da vida humana a partir das reflexões de Roberto Esposito, problematizando a seguinte questão: em tempos de pandemia viral e, consequentemente, de Estados emergenciais, de que maneira o paradigma imunitário atua sobre a vida humana? A hipótese que gostaríamos de desenvolver parte do relevo de que, em crises agudas, o paradigma imunitário é tensionado ao seu limite, convergindo para a produção de Estados de emergência segundo os quais (...) são responsáveis por introduzir políticas nefastas de produção tanto da vida quanto da morte. Para validar nossa hipótese e desenvolver o objetivo e a problemática da pesquisa, o presente texto se organiza em dois momentos: primeiramente, nosso intuito consiste em apresentar brevemente a reflexão de Esposito acerca do paradigma imunitário; em seguida, temos como fito analisar criticamente o estado de pandemia viral à luz do paradigma imunitário, buscando encontrar vestígios de como tal ferramenta conceitual nos permite desenvolver uma interpretação para o tempo presente. Relevant formal properties of situated legal systems are discussed; the way they are exposed in the operational semantical framework is explained, and their truth formally proved. Also, for the sake of a better understanding of the legal-theoretic assumptions of the paper, recurring issues regarding Kelsen’s theory (...) of law are briefly reviewed. They are put in confrontation with the points of view of R. Dworkin, H. Hart, and J. Raz, and an attempt is made to clarify them from the perspective of the provided formalization. A brief case study in agent-based modeling and simulation of public policy processes is presented, as an illustration of the way of using situated legal systems, and the proposed operational semantical framework, in a practical application. O presente artigo tem como objetivo fazer uma cartografia das possibilidades Ecofenomenológicas acerca do imaginário da natureza na filosofia. Tal intento se dá pelo fato da filosofia enquanto disciplina não ter materiais didáticos diretamente ligados a essa perspectiva quando em diálogo com as ciências naturais. Apesar de termos diversos pensadores contemporâneos no âmbito da filosofia que tratam de questões como a natureza, ecologia e meio ambiente, é a partir de pensadores como Bachelard, Gadamer, Merleau-Ponty, que queremos fazer uma interpretação do (...) imaginário da fenomenologia natureza. Logo, por meio de uma metodologia ecohermenêutica pretendemos por meio desse manuscrito apontar caminhos possíveis para a construção dialógica dessa temática e de como ela tem ressonância e repercussão crítica junto a filosofia da técnica e a imaginação.
